Complete Reversal at the Patent Trial and Appeal Board

Weide & Miller obtains a complete reversal at the Patent Trial and Appeal Board. Weide & Miller had appealed the examiner’s rejection of all claims in U.S. Application Serial No. 15/057,289, directed to a closed-loop medication monitoring and feedback system. The examiner had rejected all claims over prior art under Section 103 as “obvious”, and for double-patenting. Weide & Miller successfully argued that both grounds of rejection were meritless, winning a complete reversal of the examiner.
